VI - 1.05 - Policy on Non-Discrimination on the Basis of Sexual Orientation
Bowie State University is committed to the most fundamental principles of academic freedom, equality of opportunity, and human dignity. This commitment requires that treatment of students, faculty, staff, including applicants for admission and employment, be based on individual abilities and qualifications and be free from invidious discrimination.
This policy specifically prohibits discrimination against students, faculty, and staff on the basis of sexual orientation in academic admissions, financial aid, educational services, housing, student programs and activities, recruitment, hiring, employment, appointment, promotion, tenure, demotion, transfer, layoff or termination, rates of pay, selection for training and professional development, and all employee services.
"Sexual Orientation" is defined as the identification, perception, or status of an individual as to homosexuality, heterosexuality, or bisexuality. Discrimination on the basis of sexual orientation is prohibited by State and Federal Law.
Bowie State University is a recipient of Federal funding and a member institution of the University System of Maryland and as such must adhere to the policies and procedures of such requirements. Violations reported under this policy will be investigated by the Office of Equal Employment Opportunity Programs (Hereinafter "EEO Programs").
Students alleging discrimination on the basis of sexual orientation may notify their faculty advisor, the Vice President of Student and Academic Services, or they may contact the Office of EEO Programs directly. Members of the faculty may contact Chairs of their departments, Deans, or the Office of EEO Programs directly. Administrative staff may report incidents to the Director of the Human Resources Department or the Office of EEO Programs directly.
All persons notified must notify the Office of EEO Programs within three (3) business days of receiving information of possible violations. The Office of EEO Programs will notify the complainant (s) within five (5) business days to determine the merits of the case. Should the allegations warrant a full investigation, persons accused of such violations will be notified within thirty (30) days that a complaint has been filed against them and informed of the procedures involved in the investigation.
Should individuals be found to have violated this policy prohibiting discrimination on the basis of sexual orientations, the University shall take actions to institute disciplinary proceedings against the individual, based on the totality of the circumstances involved. Disciplinary actions against students may include, but not limited to, the following: counseling, written letter of admonishment to be placed in student records for a period, not to exceed one (1) year, disciplinary suspension, and disciplinary dismissal. Actions against faculty and administrative staff may include, but not limited to, the following: counseling, letter of admonishment placed in the employees file, not to exceed two (2) years, suspension without pay, and termination.
